General​
 

• These terms and conditions apply to all undertakings pertaining to Magic Memories Keepsakes, unless specifically agreed to in writing by the business owner. This includes, but is not limited to, offers, orders, requests, communications and agreements involving Magic Memories Keepsakes.

• Magic Memories Keepsakes terms and conditions apply exclusively in all business dealings involving Magic Memories Keepsakes, unless expressly agreed to in writing.

• Magic Memories Keepsakes may accept differing terms and conditions by way of a written agreement. Magic Memories Keepsakes will not be bound by differing terms and conditions unless specifically agreed to in writing.
   

Offers
 

• Any offers made by Magic Memories Keepsakes, whether verbal, in writing or published (either online or in print) are subject to change at anytime without notice.

• All prices specified by Magic Memories Keepsakes are inclusive of GST. Insurance, freight and delivery costs are charged separately at checkout.

• Any crafting times advised by Magic Memories Keepsakes are an estimate only, and do not constitute an agreement or firm deadline. No refunds will be given by Magic Memories Keepsakes due to 'exceeding' the customers estimated turnaround time.
   

Pricing
 

• Magic Memories Keepsakes prices are calculated based on many varying factors, and are subject to change without prior notice. Factors considered include metal and gem pricing, exchange rates, cost of materials, transport, wages, taxes and levies, import duties and other price-determining costs.

• In the event that there is a change to a price-determining cost, Magic Memories Keepsakes reserves the right to adjust pricing at any time without notice. In the event that a price is increased after an agreement was entered into, the price will remain as agreed upon at payment date.
   

Agreements
 

• Magic Memories Keepsakes considers an agreement has been made when an order and payment have been received. An order confirmation can be considered an acknowledgement of the agreement.  Any changes to the agreement will only be made and/or accepted by Magic Memories Keepsakes in writing.

• Magic Memories Keepsakes considers the agreement to be concluded when an order has been dispatched.

• Agreements with, or statements from staff members of Magic Memories Keepsakes are not considered binding. The business owner: Breanna Quayle is the only person who has the power to make agreements on behalf of Magic Memories Keepsakes.

• Where any changes or cancellations to orders are made, the other party remains bound to the order. No changes or refunds can be accepted after a period of 7 days from placing an order online.
   

Crafting Orders
 

• Any crafting timeframe provided by Magic Memories Keepsakes is an estimate. Magic Memories Keepsakes is not bound by any dates or deadlines provided, and is not liable from any deviations.  Exceeding a crafting time does not entitle the buyer to compensation, dissolve or change the agreement.

• Crafting times are provided based on the normal operations of a number of different stakeholders. Although Magic Memories Keepsakes is not bound by crafting times, they are provided in good faith that they should be correct during normal operations.

• A crafting time for an order becomes relevant only when an order is placed and paid for, and Magic Memories Keepsakes have received any inclusions or information necessary to complete the order (including sizing and colour choices).

• Magic Memories Keepsakes considers the crafting time to be complete when an order is dispatched.

• In the event of an order that involves multiple items, Magic Memories Keepsakes reserves the right to hold any completed items until all items in the order are complete and ready to be dispatched. A partial delivery will invoke an extra shipping cost, which the customer is liable for.

• As items are hand-crafted, minor deviations in colour and appearance are to be expected within the stone and setting.
   

Risk & Liability
 

• All orders shipped by Magic Memories Keepsakes are insured by Magic Memories Keepsakes against loss and damage during transport. Magic Memories Keepsakes is not liable for damage to orders that occur through transport.

• Where loss or damage to an order occurs, Magic Memories Keepsakes liability is strictly limited to the amount paid by Magic Memories Keepsakes insurer.

• Should Magic Memories Keepsakes be in fault of incorrect shipping, Magic Memories Keepsakes will reimburse damages that are regarded as an immediate and direct consequence of its failure to comply with the agreement.

• Any keepsakes lost in transit are no fault of Magic Memories Keepsakes and Magic Memories Keepsakes will not be required to replace lost keepsakes or compensate for lost inclusions. 

• Any loss of personal assets during transit are of no liability to Magic Memories Keepsakes.
   

Defects, Bubbles, Scratches & Colour
 

• Air bubbles in resin are natural and although artists go to great effort to prevent them there may be some visible. This is a normal element in hand made resin jewellery and air bubbles will not be classed as faults

• We often find fibers in locks of hair and other elements and try our best to remove what we can but some may still be visible.

• Colors of elements may vary, photos on the website are of other clients elements and your piece will differ even with clear resin.

• Pieces will never look the same as those on our website because they are all handmade and the elements you send in vary.

• Locks of hair vary in colour and may be transparent (white/blonde) and may not be as visible in resin as darker hair.

• Keepsakes stones will yellow overtime, this is no fault of Magic Memories Keepsakes. Magic Memories Keepsakes will not be required to replace or fix Stones if yellowing or discolouring occurs.

• The silver and gold will mark if scratched as with most handmade jewellery that is not mass produced.

Complaints
 

• Any order complaints must be submitted in writing, including photographs where appropriate, within 7 days of receiving delivery.

• Magic Memories Keepsakes are not liable for any wear and tear, deterioration, or damaged caused by improper use or failure to adhere to care instructions.

• Any complaints will be individually assessed. Where Magic Memories Keepsakes is accountable for failing in the execution of an agreement, Magic Memories Keepsakes reserves the right to recraft or refund, as appropriate to the situation.
   

Force Majeure
 

• Force majeure is a circumstance that is outside of Magic Memories Keepsakes control.

• Without prejudice to any of Magic Memories Keepsakes other rights, Magic Memories Keepsakes reserves the right to suspend or dissolve an agreement partially or completely through a written statement, without liability to compensation or damages, if Magic Memories Keepsakes is unable to execute the agreement due to force majeure.
   

Custody & Insurance of Goods
 

• Where Magic Memories Keepsakes is in possession of goods of the other party, for the purposes of executing an agreement, those goods are insured against risks of fire and burglary under the terms and conditions of its general policy. Details of Magic Memories Keepsakes insurance policy may be provided upon request. Magic Memories Keepsakes is not liable for damage to orders that occur through transport that are outside of the insurance conditions.
